Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the TopperOS mobile application (“App”) and the website at www.topperos.com (“Website”), operated by Balihans Software Private Limited (“Company”, “we”, “us”, or “our”).

By creating an account or using any part of the service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

2. Service Description

TopperOS is a UPSC exam preparation platform that provides:

• ›A Prelims question bank with performance analytics
• ›AI-assisted Mains answer evaluation powered by Google Gemini
• ›AI-driven DAF-based mock interview simulation
• ›Syllabus tracker and study progress tools
• ›Mistake vault and revision features

TopperOS is a preparation aid only. It is not affiliated with, endorsed by, or connected to the Union Public Service Commission (UPSC) in any way. We make no guarantee of success in any examination.

3. Eligibility

• ›You must be 18 years of age or older to use TopperOS.
• ›You must be a resident of India or otherwise able to lawfully use the service under the laws of your jurisdiction.
• ›By using the App, you represent and warrant that you meet these requirements.

4. Account Registration & Security

• ›You must provide a valid email address and create a password to use TopperOS.
• ›You are responsible for maintaining the confidentiality of your account credentials.
• ›You agree to notify us immediately at enquiries@balihans.com if you suspect any unauthorised access to your account.
• ›One person may hold only one account. Creating multiple accounts to circumvent usage limits is prohibited.
• ›We reserve the right to suspend or terminate accounts found in violation of these Terms.

5. Subscription Plans & Billing

TopperOS offers the following plans:

• ›Paid plans are billed monthly from the date of purchase and auto-renew each month until you cancel.
• ›All prices are inclusive of applicable taxes unless stated otherwise.
• ›Payments are processed securely via PhonePe. We do not store your payment card or UPI details.
• ›Unused evaluation credits or interview sessions within a billing month do not carry over to the next month.
• ›You may cancel your subscription at any time before the next renewal date to avoid being charged for the following month. Access continues until the end of the paid period.
• ›We reserve the right to change plan pricing with at least 14 days' notice. Changes will not affect your current billing period.

6. Acceptable Use

You agree not to:

• ›Use the service for any unlawful purpose or in violation of these Terms
• ›Attempt to reverse-engineer, decompile, or extract source code from the App
• ›Use automated tools, bots, or scripts to access the service
• ›Share, resell, or sublicense your account or subscription to others
• ›Upload content that is offensive, defamatory, or violates any third-party rights
• ›Attempt to gain unauthorised access to other users' accounts or our infrastructure
• ›Use the service in any way that degrades performance or availability for other users

Violation of these rules may result in immediate account termination without refund.

7. AI-Generated Content Disclaimer

• ›Mains answer evaluations and interview feedback are generated by Google Gemini AI and are intended as practice guidance only.
• ›AI-generated evaluations may contain errors, omissions, or subjective assessments. They do not represent official UPSC examiner opinions.
• ›We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific examination needs.
• ›You should exercise independent judgement and consult qualified mentors or educators for critical preparation decisions.

8. Intellectual Property

• ›All content in TopperOS — including question banks, UI design, branding, algorithms, and software — is the exclusive property of Balihans Software Private Limited.
• ›Your subscription grants you a limited, non-exclusive, non-transferable licence to use the App for personal, non-commercial UPSC preparation purposes.
• ›You may not reproduce, distribute, or create derivative works from any part of TopperOS without our written consent.
• ›Your exam answers, notes, and uploaded content remain your property. You grant us a limited licence to process them solely to deliver the service.

9. Disclaimers

• ›TopperOS is provided “as is” and “as available” without warranties of any kind, express or implied.
• ›We do not warrant that the service will be uninterrupted, error-free, or free from viruses or harmful components.
• ›We are not responsible for any loss of data due to technical failures. We recommend keeping personal backups of critical study notes.
• ›Results achieved using TopperOS depend entirely on individual effort. We make no representation about exam outcomes.

10. Limitation of Liability

To the maximum extent permitted by applicable Indian law, Balihans Software Private Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill arising from your use of or inability to use TopperOS.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the amount paid by you to us in the three months preceding the claim.

11. Termination

• ›You may delete your account at any time by emailing dpo@balihans.com.
• ›We may suspend or terminate your account immediately if you breach these Terms, engage in fraudulent activity, or if we are required to do so by law.
• ›Upon termination, your right to use the service ceases immediately. Paid subscription access will continue until the end of the current billing period; no partial refunds will be issued for terminations initiated by you.
• ›Terminations for breach of Terms are not eligible for any refund.

12. Governing Law & Dispute Resolution

• ›These Terms are governed by the laws of India, without regard to conflict of law principles.
• ›Any disputes arising out of or relating to these Terms shall first be attempted to be resolved amicably by contacting us at enquiries@balihans.com.
• ›If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Bangalore, Karnataka, India.

13. Changes to These Terms

• ›We may update these Terms from time to time. Material changes will be notified via in-app notice or email at least 7 days before they take effect.
• ›Continued use of TopperOS after the effective date constitutes your acceptance of the revised Terms.
• ›The current effective date is always shown at the top of this page.
